By accessing and using the services provided by Wolff Creative ("we," "our," or "us"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Service Agreement
Project Scope and Deliverables
All projects begin with a detailed scope of work that outlines:
- Specific deliverables and milestones
- Timeline and project phases
- Client responsibilities and requirements
- Payment terms and schedule
Client Responsibilities
Clients are responsible for:
- Providing accurate and complete project requirements
- Timely delivery of content, assets, and feedback
- Making payments according to agreed schedule
- Maintaining confidentiality of any sensitive information shared
- Ensuring they have rights to any materials provided
Payment Terms
Pricing and Billing
- Project-Based: Fixed pricing based on scope of work
- Hourly Rates: Time-based billing for ongoing or consultation work
- Retainer: Monthly recurring services with agreed-upon deliverables
Payment Schedule
- Projects over $2,000 require a 50% deposit to begin work
- Remaining balance due upon project completion
- Monthly retainers billed in advance
- Late payments subject to 1.5% monthly service charge
Refund Policy
Deposits are non-refundable once work has commenced. Refunds for completed work are considered on a case-by-case basis. Clients may request refunds for work not yet performed if project is cancelled with 48 hours notice.
Intellectual Property
Ownership of Work Product
- Custom Development: Client owns final deliverables upon full payment
- Code and Design: Original work becomes client property after payment
- Third-Party Assets: Client responsible for licensing of stock photos, fonts, or plugins
- Portfolio Usage: We retain rights to display work in portfolio and marketing materials
Pre-Existing Materials
We retain ownership of any pre-existing intellectual property, methodologies, or tools used in delivering services. Clients receive a non-exclusive license to use such materials as part of their delivered project.
Project Timeline and Revisions
Timeline Expectations
- Project timelines are estimates based on scope and client responsiveness
- Delays in client feedback or asset delivery may extend timelines
- Major scope changes will require timeline and budget adjustments
Revision Policy
- Two rounds of revisions included in project pricing
- Additional revisions billed at hourly rates
- Major design or functionality changes considered scope increases
- Revisions must be requested within 30 days of delivery
Website Maintenance and Support
Post-Launch Support
- 30 days of bug fixes and technical issues included
- Training provided on content management systems
- Ongoing maintenance available through separate agreements
Website Performance
While we strive for optimal performance, we cannot guarantee specific uptime or loading speeds as these depend on hosting providers, content delivery networks, and third-party services beyond our control.
Limitation of Liability
Wolff Creative's liability is limited to the amount paid for services. We are not liable for indirect, incidental, or consequential damages including lost profits, business interruption, or data loss.
Confidentiality
We maintain strict confidentiality regarding client information and project details. We will not share confidential information with third parties without explicit consent, except as required by law.
Termination
Project Termination
- Either party may terminate with written notice
- Client responsible for payment of completed work
- Work in progress billed pro-rata based on completion percentage
- Client receives all completed deliverables upon final payment
Ongoing Service Termination
- Monthly services require 30 days notice for cancellation
- No refunds for partial months of service
- Client retains access to completed work and deliverables
Force Majeure
We are not liable for delays or failures due to circumstances beyond our reasonable control, including natural disasters, government actions, internet outages, or other unforeseeable events.
Dispute Resolution
Any disputes will be resolved through good faith negotiation. If resolution cannot be reached, disputes will be settled through binding arbitration in Maryland under the rules of the American Arbitration Association.
Governing Law
These terms are governed by the laws of the State of Maryland. Any legal proceedings will be conducted in Maryland state or federal courts.
Changes to Terms
We reserve the right to modify these terms at any time. Changes will be posted on this page with an updated effective date. Continued use of our services constitutes acceptance of revised terms.
Severability
If any provision of these terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
